This agreement sets out the terms and conditions for the tax preparation and filing services provided by Tax eFile or its service provider (referred to as “I”, “me”, “my”, “we”, or “us”) to the client (referred to as “you”, “yourself”, “your”, “yours”, or “client”).
SERVICES PROVIDED
We will prepare and file the personal income tax returns of you and your family, and the tax return of your business in the form of sole proprietor, partnership, corporation or trust, for the year or period specified during your order and execute the task and transact based on the service ordered. You acknowledge and agree that we do not provide any consultancy or advice, but instead, prepare and execute based on the information and instruction we receive from you. It is your responsibility to ensure that you have selected the correct option/package that best matches your needs.

PURCHASE AND RETAINER
Making a purchase of any service does not constitute a retainer, nor do we provide ongoing support. Our scope of work is limited to preparing and filling the tax returns based on the information we receive and the option/package selected by you.
ACCURACY OF INFORMATION AND COMPLETENESS OF REPRESENTATIONS
You acknowledge and agree that the accuracy of the information and completeness of the representations reflected in your tax returns, filing, and other executions are your responsibility under the laws applicable in Canada. You represent and warrant that, to your knowledge, the information supplied is correct and complete, and fully disclose all your reporting requirements under the Income Tax Act and other legislations.
DETAILS AND SUMMARIES OF INCOME AND DEDUCTION ITEMS
You confirm that you have provided us with the details and
summaries of all income and deduction items to be included in the tax returns, and that they are correct and complete. You confirm that all sources of income have been disclosed, all deductions were incurred to earn income, and all credits claimed are supported by receipts. You further confirm that:
- All business (including commission, farming and professional incomes) and rental schedules present the results of operations and include all transactions.
- All income and benefits from employment have been reported, whether or not they are on T4 slips.
- All incomes from investments (whether received or not) have been reported, whether or not they are on the T3 and T5 slips.
- All dispositions of a capital nature, and their costs, have been reported.
- All estimates of personal use of an automobile, business portion of the residence, and other such estimates you have provided are reasonable and supported by usage logs and other evidence.
OWNERSHIP OF PROPERTY OUTSIDE OF CANADA
If you owned certain property outside of Canada totaling more than $100,000 at any time during the year, you might need to declare such ownership in your tax returns. There are substantial fines and penalties for non-compliance. You confirm and warrant that:
- You have provided us with the correct and complete information regarding ownership of, or beneficial interests in, specified foreign property as reported on the Foreign Income Verification Statement (T1135). You have fully disclosed the related foreign income.
- You did not, at any time during the year, own or hold beneficial interests in foreign property totaling more than $100,000.
DISCLOSURE OF ILLEGAL ACTS
You confirm that you are not aware of any illegal or possibly illegal acts for which you have not disclosed all related facts.
AUDIT, REVIEW OR VERIFICATION
We will not audit, review or otherwise attempt to verify the accuracy or completeness of any information provided. The responsibility remains with you. Please note that our engagement does not guarantee the detection of errors or irregularities in the information. However, if we become aware of any such matters, we will inform you promptly. It’s essential that you carefully review and assess your tax returns, information returns and other documents before signing, dispatching or asking us to efile or execute as you hold the final responsibility for them in all aspects.
RECORD KEEPING
It’s important to keep in mind that you are responsible for ensuring the accuracy of the income and other information you report on your tax returns, as well as the deductions or credits you claim. Ultimately, you are accountable for your tax return. Please make sure to maintain records that support your income and deductions, as required by tax authorities.
PERSONAL INFORMATION
We understand that you trust us with your personal information, and we take this responsibility seriously. We and our service providers will have access to all personal information necessary to complete the engagement, but we will hold this information confidential and use it only for the purpose of completing the engagement.
We ask that you represent to us that you have obtained any required consent for the collection, use, and disclosure of personal information required under applicable privacy legislation.
FILE INSPECTIONS
To ensure that we are adhering to professional and quality standards, our client files may periodically be reviewed by practice inspectors from our professional body, revenue agencies, network firm, or association. We want to assure you that these practice inspectors are bound to maintain the confidentiality of your personal and financial information.
In the event of an inspection by authorities, if we must redo an engagement or its related work, you agree to cooperate and provide information promptly to complete the job as advised by authorities.
LIMITATION OF LIABILITY
We understand the importance of providing high-quality service to our clients, but there may be times when things do not go as planned. Our aggregate liability for all claims, losses, liabilities, and damages in connection with this Engagement, regardless of the theory of liability, is limited to the amount of the fee we are paid for the engagement.
We will only be liable for our proportionate share of any loss or damage not exceeding the fees we are paid for the specific engagement, based on our contribution relative to the others’ contributions. Additionally, we will not be liable for consequential, incidental, indirect, punitive, exemplary, aggravated, or special damages, including any amount for loss of profit, data, or goodwill, whether or not the likelihood of such loss or damage was contemplated.
TIME FRAMES
We strive to complete all engagements within the agreed-upon time frames. However, we acknowledge that unforeseen circumstances may arise that are beyond our reasonable control. In such cases, we shall not be liable for failures or delays in performance that arise from causes beyond our reasonable control, including but not limited to the untimely performance by the Client of its obligations, third party, any law, or requirement of any authority or government agency.
REFUND
We stand behind our work and want you to be completely satisfied with our services. If you are unsatisfied during the information exchange and return preparation stage, we offer a full refund. However, if we have produced a return for your signature, we assume we have done our job and incurred costs. In this case, we will only provide a refund of 50% of the professional fee.
Please note that we do not reimburse fees paid to third parties and governments and their agents, but we can provide receipts, summaries, statements, or a letter to explain whom they are charging us and whether we have paid them or are obliged to pay. There may also be charges by payment processors related to your purchase or refund, and we will only cover those charges related to our share of the professional fee we earn.
WARRANTY
We are committed to providing accurate and error-free work. If we make an error in the form, we will make a correction and refile it at no additional charge to you.
